Software Terms of Use
Last updated August 28, 2026
These terms govern use of the EsVata dealer portal, the EsVata mobile apps, and the connected services they offer. They are between EsVata LLC and the business whose staff use the software. Using the software means agreeing to them.
What you get
While your account is in good standing, EsVata grants your business a non-exclusive, non-transferable right to use the software to run your window-covering business: to quote, order, schedule, invoice, and manage your own customers.
The software is provided as a service. We host it, we update it, and we may change how it works. We will not remove a capability you depend on without telling you first.
What you may not do
You may not resell or sublicense access to the software, share logins outside your business, attempt to access another dealer’s data, reverse-engineer the software, or use it to store anything unlawful.
You are responsible for what your staff do with their logins, and for the accuracy of what you enter — measurements especially. The software helps you check your work; it does not take responsibility for it.
Your data is yours
The records you create — your customers, quotes, orders, photographs, notes — belong to you. We hold them to run the service, and we handle them as described in our Privacy Policy.
You can export your data, and you can ask us for a copy at any time while your account is open.
Connected accounts
The software can connect to services you already use, including QuickBooks Online, Stripe, Google, and your own email. Connecting one authorizes us to act in that service on your behalf, for the purposes the portal describes at the point you connect.
You can disconnect any of them at any time. Records already written into a connected service stay there — they are yours, in your account, and it is not our place to remove them.
Anything we write into your accounting system is a copy of what our software already shows. Reviewing it is your responsibility, and so is your bookkeeping. We refuse to send a document whose figures do not reconcile rather than adjust it, and we will tell you when that happens.
Fees
Some capabilities are included with your dealer account; others are paid add-ons, priced in the portal before you switch them on. Paid features are billed monthly in advance and are not prorated when switched off mid-cycle.
If your balance cannot cover a paid feature, that feature pauses. Your data and your connections are kept, and it resumes when the balance does.
Availability
We work to keep the software available and correct, but we do not promise it will be uninterrupted or error-free. Planned maintenance is announced in advance where we can.
Liability
To the extent the law allows, EsVata is not liable for indirect or consequential loss, and our total liability for any claim relating to the software is limited to the fees you paid us for it in the twelve months before the claim.
Nothing here limits liability that cannot lawfully be limited.
Ending the agreement
You may stop using the software at any time and ask us to close your account. We may suspend or close an account that breaches these terms, or that puts other dealers or the service at risk — and where circumstances allow, we will tell you why and give you a chance to put it right.
On closure you can request an export of your data. Records we are required to retain, such as accounting records, are kept as described in our Privacy Policy.
Changes to these terms
We may update these terms. Material changes are announced in the portal before they take effect, and continuing to use the software after that is acceptance of them.
Governing law
These terms are governed by the laws of the State of California, and the courts of California have exclusive jurisdiction over disputes arising from them.
